FDA to Consider Studies Related to California Yaz Lawsuits

Since 2004, thousands of patients taking birth Yasmin and Yaz birth control pills have come forward with complaints of blood clots, gallbladder problems, and kidney problems related to their prescriptions. Despite years of complaints to the Federal Drug Administration, the government agency has not recalled the product, made by manufacturer Bayer. That could change, as the FDA has announced more recently that it will consider a set of British studies which showed that blood clots were up to three times more common for women taking birth control pills containing drospirenone, an active ingredient in Yasmin and Yaz. The results are sure to impact California Yaz lawsuits.

Motives Questioned in Case Against California Yaz Lawsuits

Common among these complaints is the accusation that Bayer wrongly marketed its popular birth control drug toward teenagers promising that in addition to preventing pregnancies, Yaz would reduce acne and prevent a severe form of premenstrual syndrome. And while Bayer advertised some of the Yaz side effects, it never mentioned the potential for blood clots, gall bladder disease, and even strokes, symptoms that have been increasingly accepted by the medical community.

California Yaz MDL Dismisses Third Party Payor Complaints

Last week, the Yaz MDL court sided with Bayor and ruled that third-party claims against the drug maker were too remote to justify sufficient injury necessary for standing. According to the brief, the plaintiffs argued that anyone who "purchased, reimbursed, and/or paid for all or part of the cost of YAZ" should be able to sue the drug's parent company Bayer because it engaged in "fraudulent, misleading, and unlawful advertising campaign that wrongfully promoted YAZ as safe and effective for unapproved off-label uses and concelaed or omitted facts pertaining to YAZ's safety profile."

In May, the Plaintiffs Steering Committee met to assign leadership roles and begin communicating with defendants and make decisions on behalf of Yaz lawsuits here in California. On the federal level, Bayer has provided the MDL Discovery Committee millions of Yasmin and Yaz documents to review and code.
